1. Who we are
Vivanesse ("Vivanesse," "we," "us," or "our") operates the online store at vivanesse.com (the "Site"). Vivanesse is operated by 411 Solutions LLC, a United States limited liability company.
This Privacy Policy explains what personal information we collect when you visit the Site, make a purchase, sign up for our emails or text messages, or otherwise contact us, and how we use, share and protect it. It also explains the privacy rights you may have under U.S. state law and how to exercise them.
The Site is intended for customers in the United States. By using the Site, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Site.

Payments. Payments are processed by Shopify Payments, PayPal and buy-now-pay-later providers such as Shop Pay Installments, Klarna or Afterpay. These providers collect your payment details directly under their own privacy policies. If you choose a buy-now-pay-later option, that provider may also perform identity or credit checks under its own terms.
Sensitive information. We do not ask you to provide medical records, diagnoses or other health details. Please do not send us such information through chat, email or reviews.
3. How we use your information
We use personal information to run our store and serve you. Specifically, we use it to:
- Process, ship and deliver your orders, including passing order details to our suppliers and shipping carriers
- Handle payments, returns, refunds and our money-back guarantee
- Send order confirmations, shipping updates and other service messages
- Answer your questions through email, live chat or text
- Send marketing emails and text messages, if you have opted in
- Show you relevant ads on Facebook and Instagram and measure how well our ads work
- Display product reviews you choose to publish
- Understand how visitors use the Site so we can improve it
- Detect and prevent fraud, abuse and security incidents
- Comply with legal obligations, resolve disputes and enforce our Terms of Service
We do not use your information for automated decisions that produce legal or similarly significant effects about you.
4. Cookies, the Meta Pixel and similar technologies
We and our partners use cookies, pixels and similar technologies to keep the Site working, remember your cart, understand how the Site is used and support advertising.
- Essential cookies keep your cart, checkout and login working. The Site cannot work properly without them.
- Analytics provided by Shopify help us see which pages are visited and how the store performs.
- The Meta Pixel (Facebook and Instagram) records actions on the Site, such as pages viewed, items added to cart and purchases. Meta uses this to show our ads to people likely to be interested, to show you our ads after you visit the Site, and to measure ad results. Meta may combine this with information it already holds about you under Meta's Privacy Policy.
Your choices. You can block or delete cookies in your browser settings, though parts of the Site may stop working. You can control the ads you see in your Facebook ad preferences and opt out of interest-based advertising from many companies at YourAdChoices. You can also opt out of targeted advertising by Vivanesse as described in Section 8.
Global Privacy Control and Do Not Track. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising for that browser. The Site does not respond to "Do Not Track" signals, because no common industry standard for them exists.

Targeted advertising. Under some state laws, sharing information through the Meta Pixel for targeted advertising may count as a "sale" or "sharing" of personal information. You can opt out of this at any time, as explained in Section 8.
6. Emails, text messages, live chat and reviews
Marketing emails. If you subscribe, we send emails about products, offers and news. You can unsubscribe at any time with the link at the bottom of every email. We will still send service emails about your orders.
Text messages (SMS). If you opt in, we send recurring automated marketing and order-related text messages to the mobile number you provide.
- Consent to receive marketing texts is not a condition of any purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to unsubscribe at any time, or HELP for help. You can also contact us at hi@vivanesse.com.
- Carriers are not liable for delayed or undelivered messages.
- We do not share or sell your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing purposes. Mobile information is shared only with the service providers that send our messages.
Live chat. Messages you send through our chat are stored by our chat provider and used to answer your questions and improve our support.
Reviews. If you submit a review, your first name or display name, rating, review text and any photos you upload may be published on the Site. Please do not include personal details you do not want to make public.
7. Consumer health data, children, retention and security
Consumer health data. Because we sell health and beauty products, your purchase and browsing history could suggest information about your health, such as interest in a particular wellness product. Some state laws, including Washington's My Health My Data Act and Nevada law, treat this as consumer health data. We collect it only to provide the products you request, we do not sell it, and we share it only with the service providers needed to process and deliver your order. Residents of these states can find more detail in our Consumer Health Data Privacy Policy.
Children. The Site is not directed to children under 13, and we do not knowingly collect personal information from them. You must be at least 18, or the age of majority where you live, to make a purchase. If you believe a child has given us personal information, contact us and we will delete it.
How long we keep information. We keep personal information for as long as needed for the purposes in this policy. Order and transaction records are generally kept for up to 7 years to meet tax and accounting requirements. Marketing data is kept until you unsubscribe or ask us to delete it.
Security. We use reasonable technical and organizational measures to protect personal information, and the Site uses encrypted (SSL/TLS) connections. Payment card data is handled by PCI-compliant payment providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Links to other websites. The Site may link to websites we do not control. Their privacy practices are governed by their own policies.
8. Your privacy rights
Depending on the state you live in, including California, Colorado, Connecticut, Texas, Virginia and other states with consumer privacy laws, you may have the right to:
- Know and access the personal information we hold about you and receive a copy in a portable format
- Correct inaccurate personal information
- Delete personal information we collected from you, subject to legal exceptions such as records we must keep for tax purposes
- Opt out of the sale or sharing of your personal information and of targeted advertising
- Limit the use of sensitive personal information, where applicable
- Appeal our decision if we decline your request
We offer these rights to all U.S. customers, whether or not your state requires it.
How to make a request. Email us at hi@vivanesse.com with the subject line "Privacy Request" and tell us which right you want to exercise. To opt out of targeted advertising, you can also enable Global Privacy Control in your browser (see Section 4).
Verification. To protect your information, we will ask you to confirm your identity, usually by matching the email address and order details we have on file. You may use an authorized agent to make a request for you; we may ask the agent for proof of your written permission and may ask you to confirm your identity directly.
Timing. We respond to verified requests within 45 days. If we need more time, we will tell you why and may extend this period as permitted by law.
Appeals. If we decline your request, you can appeal by replying to our decision or emailing hi@vivanesse.com with the subject line "Privacy Appeal." We will respond within the time required by your state's law. If you are not satisfied, you may contact your state Attorney General.
No discrimination. We will not deny you goods, charge you different prices or provide a different quality of service because you exercised your privacy rights.
California "Shine the Light." California residents may request information about any disclosure of personal information to third parties for their own direct marketing purposes. We do not make such disclosures.
9. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top. If we make material changes, we will notify you by email or with a notice on the Site before the changes take effect.
